“On Aug 19, commissioners court voted to cut 100+ voting locations after extremely short notice. Still, a large number of speakers came and spoke out against voter suppression. Alisa Simmons calls out commissioner court members for ignoring the plea, after 95% of speakers were against closing so man[y locations]”: https://www.reddit.com/r/law/comments/1mz6qwu/on_aug_19_commissioners_court_voted_to_cut_100/

August 25 2025: Trump signs executive order to make burning the American flag subject to criminal prosecution: https://www.reddit.com/r/law/comments/1mzty2n/trump_signs_executive_order_to_make_burning_the/

This was already ruled to be protected under the first amendment by the Supreme Court. The Trump admin decides to be snakes and utilize any other charges possible when someone burns the flag.

One day later, a man appears to be detained for burning the American flag: https://reddit.com/r/law/comments/1n06xgy/detained_for_burning_the_american_flag/

If it's legal to burn the country to the ground, it should be legal to burn the country's flag.

RE: The United States' descent into fascism - Clover - Sep 17 2025

Ummmmm a lot has happened since last post. Mainly Charlie Kirk was shot dead and the right-wing administration is using that to push all sorts of authoritarian policies and rhetoric.

Besides that, September 16 2025: “She Pushed To Overturn Trump’s Loss In The 2020 Election. Now She’ll Help Oversee U.S. Election Security.” https://www.techdirt.com/2025/09/16/she-pushed-to-overturn-trumps-loss-in-the-2020-election-now-shell-help-oversee-u-s-election-security/

Starkoman When the presence of Cleta Mitchell is unearthed (by association with Heather Honey), you can bet the farm there’s sinister dealings — and something very crooked — occurring.

Mitchell has absolutely no moral sense of right or wrong.  Not when it comes to supporting Donald Trump by any means necessary.  Past actions prove that.

Her 2020 election interference/meddling (in Georgia), on Trumps’ behalf was brazen and appalling.  The conniving and criminal actions could (should) have landed her in prison.  It was that close.

Recall, Mitchell was one of those in attendance, in fact helping — during the infamous Trump/Brad Raffensperger “Just find me 11,780 votes”, telephone call.  It was Mitchell who provided those numbers to Trump (and is audible on the tape doing so).

If memory serves, Texas State Bar ultimately declined to disbar Mitchell from the profession.  Nevertheless, the law firm she (possibly) co-founded* and was definitely a partner in — decided to let her go (she jumped before she was pushed).

Her uncontrolled, false and bizarre claims on television and in the press, the bad publicity she brought down upon the company and subsequent complaints by clients, had made her toxic to the entire firm.

But Mitchell didn’t fade away into quiet obscurity.  She’s been up to her eyeballs in dirty tricks for MAGA ever since.  Her name comes up in background searches whenever they’re up to something legally or morally sketchy.

(After all, they can no longer use Eastman, Chesebro, Wood, Powell, Ellis, Giuliani, Clark, et al.)

Now we read that Cleta Mitchells’ disturbing protégé, Heather Honey, has been appointed Deputy Assistant Secretary of Election Integrity at the Department of Homeland Security.

The words Fox and Henhouse loom large here.

With this position, we all finally know — for sure — that the lunatics have truly taken over inside the asylum at DHS.

Honey, the known and active election denier — is one of the most unsuitable people in the country that one could possibly insert into the Department of Homeland Securitys’ Office of Election Integrity.

Shocking her name was ever floated, let alone considered.  Particularly given her history, warped Big Lie belief and dubious associations.

Heather Honey, Cleta Mitchell (and a list of others), are absolute poison for election integrity.  They have no interest in free or fair elections.  Nor in blocking out foreign interference in Americas’ elections: those are not their priorities.  They aren’t Ms. Honeys’ real concerns either.

Delegitimising, hijacking and skewing State elections in favor of President Trump and Republicans is why Honey’s been parachuted into this office within DHS.  That’s her prime mission.  Anything else she claims she’s there to do is a big, red smokescreen.

September 18 2025: "Trump targets antifa movement as 'terrorist organization'" https://www.reuters.com/world/us/trump-targets-antifa-movement-terrorist-organization-2025-09-18/

Quote:Trump said on Truth Social that he was "designating" the movement as a terrorist organization. "I will also be strongly recommending that those funding ANTIFA be thoroughly investigated in accordance with the highest legal standards and practices," Trump wrote.

It was not clear what legal weight Trump's proclamation carried. Antifa is a loosely organized ideological movement without a clear leadership structure or hierarchy, experts said.

September 19 2025: “Trump: ‘It’s no longer free speech.’ The president doubled down on his claims that critical media coverage of him is "illegal."”: https://www.politico.com/news/2025/09/19/trump-no-longer-free-speech-00574219

Quote:President Donald Trump on Friday reiterated his claim that critical television coverage of him is “illegal” and pushed back on criticisms that his administration was taking actions that chill free speech.

“When 97 percent of the stories are bad about a person, it’s no longer free speech,” Trump told reporters in the Oval Office, complaining about an apparent asymmetry between his victory in the 2024 election and his treatment by media organizations. It was not immediately clear what statistics or laws he was referencing.

I thought this should probably be shared. Several other articles corroborated this information, but I'd love for jt not to be true. Consider not bringing your main phone to protests.

It sucks that we've hit the point to where everyone should consider having a cheap burner phone, for multiple reasons. No, I'm not a drug dealer, I'm just afraid of my own government. I will stop short of wrapping my phone in aluminum foil and duct taping it though. That had me laughing in that YouTube short.

hcregna It takes like half an hour of planning to shift money away from Republican-leaning businesses, and it clearly makes a difference. Every dollar spent at a Republican company is another dollar that'll get funneled into Project 2025.

If you have an account with Charles Schwab (whose founder was recently palling around with Trump), switch to Vanguard or Fidelity. It's not hard to find alternatives for Goya, Jimmy John's, New Balance, Georgia-Pacific, or Home Depot.

If you have a company that you regularly buy from/do business with, consider looking them up in something like https://www.opensecrets.org alternatively https://www.goodsuniteus.com.

Dollars add up. Tesla sales in Europe dropped by half in Europe. Target's CEO stepped down after their sales dropped in response to them capitulating to Republicans. Real, individual people made that happen.

It’s true that you probably can’t avoid giving some money to companies that at least indirectly benefit Republicans. However, there’s a pretty big difference between a company that gives massive contributions almost exclusively to Republicans vs one that is more evenly split or even leans Democrat. Good is not the enemy of perfect

Trump declaring war on United States cities: “San Francisco and Chicago, New York, Los Angeles… We'll straighten them out one-by-one. It will be a major part for some of the people in this room. It’s a war too. It’s a war from within.”

https://reddit.com/r/law/comments/1nuerng/trump_declaring_war_on_united_states_cities_san/

orangejulius I'm going to put this one back up but none of the top comments are discussing a legal issue and the OP did nothing to provide explanation or analysis or even try to identify what legal issue they think makes this belong here.

Here's an explainer of the Posse Comitatus Act from the Brennan Center and some of the gaps that might be present:

https://www.brennancenter.org/our-work/research-reports/posse-comitatus-act-explained

Here's a discussion from More Perfect between Judge Posner and Ellie Mystal about presidents and war powers in the context or korematsu but also kind of informative about the judicial approach to presidential powers and national security. It's not 100% on point but might help flesh out some knowledge about why and how the courts were set up to deal (or not deal) with this.

FWIW the admin's perspective today is they are dealing with rebels in American cities and believes their future actions will be closer to dealing with civil war style rebellion in "blue" cities so they should get Lincoln-treatment from any court challenge. You should read it.

https://radiolab.org/podcast/radiolab-presents-more-perfect-american-pendulum-i/transcript

Quote:RICHARD POSNER: So Lincoln said "Oh well Taney, he's the Chief Justice, and he said this jerk should be released. I guess I have to do that. He's the Chief Justice." No, you do that enough times as the president, you're out.

ELIE MYSTAL: It seems to me that, that's why we have courts. We have courts-

RICHARD POSNER: Oh come on.

ELIE MYSTAL: Courts to restrain the executive abuse.

RICHARD POSNER: That is not why we have... We do not have courts so that presidents can be checked in situations of a national emergency. That wasn't why courts were set up.

ELIE MYSTAL: So that (laughs)... Then what, I, I mean I guess I'm, I'm flailing now, but then what stops them. What, if court... If Congress can't stop him, and if the courts can't stop him, like what can stop a president in a time of war.

RICHARD POSNER: There's nobody. There's nobody who can check that. That's the president's responsibility.

[this a cut away comment recorded and edited in because Mystal missed a point he wanted to make] ELIE MYSTAL: Hmm. Obviously I'd like a do over, because somehow in the heat of the moment I forgot that I'm talking about defending the rights of actual American citizens, and Posner is talking about people who are rebels to the country. Um, there's probably a way where I could have said, pointed that out to him.

ELIE MYSTAL: Um, in terms of the court stepping in, I mean it happens. It happened to Truman. But you know Judge Posner is right that it doesn't happen a lot. Which is why he gets to be Judge Posner, and I'm the guy that had to check Wikipedia.

RICHARD POSNER: And by the way do you think these Supreme Court Justices are great big brains.

ELIE MYSTAL: (laughs)

RICHARD POSNER: Big stars who were selected because they're the best lawyers in the United States, and their decisions are, are usually great. You think all that? I don't. I don't have a high respect for the Supreme Court at all.

ELIE MYSTAL: (laughs) Um, I'm, I...

RICHARD POSNER: Now you look at their decisions, you look at them. How they're appointed? Who appoints them?

ELIE MYSTAL: Right. This is-

RICHARD POSNER: So why do you think the Supreme Court is such a great balance to the president in a war.

UpperApe Not even.  America's already there and it's clear they just doesn't give a shit.

The problem with Americans is that they're sold on this idea that tyranny is dramatic.  They think it's world-ending, cataclysmic stuff.  But the truth is...it's just Russia.  And America is already there.  You're not edging towards authoritarianism, you're there.  You're living in it right now.

Russia has suburbs.  Russia has groceries.  Russia has hospitals and schools and police and clubs.  Russia has basically the same life you're living now; go to school/work, get married, travel, watch movies, etc.

The difference is that Russia has a two-tier justice system, one for the rich and one for everyone else.  The government/oligarchs took all the tax money, invested (very) little back while hoarding all the wealth via government contracts, and the police and judicial processes answer to orders from above, not the law itself.  They have elections but it's a sham.  And their economy collapses due to isolationism (and incompetence, because positions are held based on loyalty, not ability) which is why they have to resort to invasion and war for resources, or shitty alliances with awful countries.

And now America is all that too.  In the space of a few years, Americans (the batshit crazy, hopelessly cruel, and cowardly compliant) have pissed away a country built inch-by-inch on sacrifices and defiance to exactly this kind of world.  And a few cozy subscriptions later, it's now just another Russia.

And it's very clear that if Americans haven't acted already, they never will.  Just like how we see with Russians.  Fuck, even Brazil put away their insurrectionist corrupt ex-president and Americans just sat around with thumbs up their asses waiting for Biden or Garland to act, like they're waiting for the supervisor to call back.

The fight we've seen in countries around the world (Honk Kong, Europe, Northern Africa) doesn't exist in America.  Americans are like Russians; just drink, complain, and don't really give a shit.

Welcome back to the genetic lottery lifestyle, I guess.

Message_10 There was a really great discussion on r/changemyview last week about fascism, and there were plenty of people arguing that we're not there yet. And somebody raised the point and basically said, "The Nazis were fascists, and yet when they were first in government, they hadn't reached the full power of the fascist ways yet either. But they sure as hell sounded like fascists, and guess what: when you talk like a fascist, and promise to do fascist things, you're a fascist before you do those things."

That's us. They've said all the things. We're just waiting around for them to catch up to what they've promised to do. Maybe they will, maybe they won't, but they sure would like to--and we know that *because they've said so.*

acousticburrito Yep we remember the fascist governments of the past for what they were like at the end of their regimes. We don’t often learn about what they were like at the beginning. Slowly they ignored laws and norms and established their power base.

People expected the incompetence of the first Trump presidency. What we have instead is a government run by very intelligent and very evil people who are well studied on how to obtain power and maintain that power. Their power is entrenched at all levels of federal state and local governments. They have rabid support amongst the youngest generations which means their ideology will be entrenched in this country for perhaps at least 60 years or so.
