No, but the law doesn't explicitly say that so I'd say it could be a good one to litigate.

Sigh. I was curious if the reason it was reported was because clinic staff are mandated reporters re: abortion (mandated reporting is exempt from HIPAA, though ofc the original intention is for abuse, not abortion) but per this document that is not the case.

Naturally, it could have also just been the fear of being prosecuted (though being pro-forced birthers is also a possibility). There’s a reason reproductive healthcare providers are leaving these states in droves, no one wants to choose between being doing your job ethically or going to jail (and then women don’t get the healthcare they need from lack of availability/fear of getting prosecuted themselves, sigh sigh sigh).

Another interesting thing is that self-managed abortion is actually not a crime in Kentucky (just performing abortions). Not that they care, which I guess explains the ā€œfetal homicideā€ charge
